Attorney Solicitation Penalty Increased. Increases the penalty for runners who unlawfully solicit cases and the attorneys who hire them. The penalty was a fine of not more than $5,000 or imprisonment up to five years, or both, for a first offense and a fine of up to $7,000 or imprisonment up to seven years, or both, for a subsequent offense. Increases penalty for a first offense to a maximum fine of $10,000 and imprisonment for not less than 90 days nor more than five years. For a subsequent offense, the penalty is a fine of up to $20,000 and imprisonment up to 15 years without benefit of parole, probation or suspension of sentence for the first five years. HB 339 Townsend; Act 690; Effective 6/29/06
Accurate data on legal costs in all litigation for which private legal counsel is appointed or employed to represent a state agency, board, or commission, including levee boards, must be maintained and be reported quarterly in writing to the attorney general by the agency, board, or commission, including levee boards. The requirement for such data maintenance and reporting shall be implemented no later than 7/1/07. (Amends R.S. 49:257(B), (C), (D), (E) and (F); adds R.S. 49:257(G))
SB 575 Barham; Act 611; Effective 8/15/06
Attorney Advertising Resolution. Resolution requests the Supreme Court to establish a committee to study attorney advertising and the need and feasibility of creating a standing committee to evaluate advertising, provide written advisory opinions, develop a handbook on advertising and recommend amendments to the Rules of Professional Conduct. The committee must report to the Supreme Court on or before 3/1/07.
